1. Acceptance of Terms

By purchasing, registering, or using any WaterBow Fitness product, service, or subscription (collectively, the “Products”), you agree to be bound by these Terms & Conditions (“Agreement”), together with our Privacy & Cookie Policy and Product Liability Waiver. If you do not agree, do not purchase or use our Products.

2. Eligibility

You represent that you are at least 18 years old. Minors aged 14–17 may use the Products only with parental supervision and consent. Use by anyone under 14 is prohibited.

3. Use of Products

You agree to use the Products only as directed and in accordance with all safety guidelines, manuals, and warnings provided. Products must be used on flat, non-slip surfaces. Beginners should remain near a stable support and consult a physician before beginning any new exercise program. You are responsible for ensuring your physical readiness to participate in any workouts or exercises.

4. Subscriptions and Digital Assets

4.1 Subscription Term: Purchase of a WaterBow includes three (3) months of complimentary access to our digital workouts and music. After that period, continued access requires a paid subscription.
4.2 Auto-Renewal: Unless cancelled through your account settings before the renewal date, your subscription will automatically renew and your payment method will be charged at the then-current rate.
4.3 Cancellation: You may cancel at any time via your account. Cancellations take effect at the end of the current billing cycle.
4.4 License: Your subscription grants a limited, non-exclusive, non-transferable license to access proprietary content. You may not copy, distribute, or share such content.

5. Intellectual Property

All WaterBow Fitness content—including workouts, music, software, designs, videos, and documentation—is owned or licensed by the Company and protected by intellectual property laws. You may not reproduce, modify, reverse engineer, or create derivative works without written permission.

6. User Obligations

You agree to:

  • Follow all safety and use instructions provided.
  • Not resell or distribute Products or content.
  • Use Products and services only for lawful purposes.
  • Keep your account credentials confidential and secure.

7. Warranty and Returns

Products are warranted against manufacturing defects in materials or workmanship for twelve (12) months from delivery. This warranty does not cover misuse, neglect, improper setup, or wear and tear.
WaterBow Fitness also offers a 30-day money-back guarantee for any reason. To return a product, log in to your account and register the return within 30 days of receipt. You are responsible for return freight (or the cost will be deducted from your refund).

8. Limitation of Liability and Indemnity

To the fullest extent permitted by law, you agree that WaterBow Fitness and its officers, employees, agents, and affiliates are not liable for any injury, loss, damage, or claim arising from the use or misuse of the Products, workouts, or related content, except for proven manufacturer defect or gross negligence.
You further agree to indemnify and hold harmless the Company from any and all claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of your use or misuse of the Products, breach of this Agreement, or violation of any law or third-party rights.

9. Health Disclaimer

Our workouts and content are for general fitness purposes only and are not a substitute for professional medical advice or treatment. Always consult a physician before starting any exercise program, particularly if you have a medical condition, injury, or are pregnant.

10. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Texas, without regard to its conflict-of-law principles.
Any dispute, controversy, or claim arising out of or relating to this Agreement or your use of the Products shall be resolved by binding arbitration in Austin, Texas, in accordance with the rules of the American Arbitration Association.
You and the Company waive the right to participate in any class action or representative proceeding.

11. Modifications to Terms

We may update or revise these Terms at any time. Continued use of our Products after such changes constitutes acceptance of the revised Terms. Material updates will be announced via our website or app.
