1. Acknowledgment of Risk

By purchasing, assembling, or using any WaterBow Fitness product, including the WaterBow, Balance Board, or any related accessories, workouts, or digital content (collectively, the “Products”), you acknowledge and agree that participation in physical exercise involves inherent risks.

These risks may include, but are not limited to: muscle strain, slips or falls, loss of balance, collisions, equipment malfunction, or other physical injury, up to and including serious injury or death.

2. Safety Confirmation

You confirm that:

  • You have read and understood all instructions, warnings, and manuals provided.
  • You will only use the Products as directed, on flat, non-slip surfaces, and with adequate space and visibility.
  • Beginners will stay near a stable surface or wall for support.
  • You have consulted a qualified medical professional and are fit to participate in physical exercise.
  • You will immediately discontinue use if you experience dizziness, pain, or discomfort.

3. Voluntary Assumption of Risk

You voluntarily and knowingly assume all risks associated with the purchase, assembly, and use of the Products, whether supervised or unsupervised, including risks arising from negligence (other than gross negligence or willful misconduct) of WaterBow Fitness or its affiliates.

4. Release and Waiver

To the maximum extent permitted by law, you hereby waive, release, and discharge Compound Strategies LLC DBA WaterBow Fitness, its officers, directors, employees, contractors, agents, distributors, and affiliates (“Released Parties”) from any and all liability, claims, demands, actions, or causes of action, whether in contract or tort, arising out of or related to:

  • The use or misuse of the Products or any WaterBow Fitness workouts or content;
  • Any injuries, losses, or damages resulting therefrom;
  • Any alleged improper design, manufacture, or training materials.

This release applies even if such loss or injury is claimed to result from ordinary negligence on the part of the Released Parties.

5. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of your use or misuse of the Products, breach of this waiver, or violation of any applicable law or regulation.

6. Limitation of Liability

In no event shall WaterBow Fitness be liable for any indirect, incidental, consequential, or special damages, including loss of profits or data, arising from or related to use of the Products, workouts, or digital services.
Total liability shall not exceed the purchase price of the specific Product giving rise to the claim.

7. Governing Law and Arbitration

This waiver shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute arising from or relating to this Waiver shall be resolved by binding arbitration in Austin, Texas, in accordance with the rules of the American Arbitration Association.
You waive the right to participate in class actions or representative proceedings.

8. Severability

If any provision of this Waiver is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Acknowledgment

By checking the acceptance box online, signing physically, or using the Products, you confirm that you have read, understood, and voluntarily agreed to this Waiver and Assumption of Risk, and that no oral representations or statements have modified its terms.
